Terms & Conditions

These terms apply when you use Bluepeak OS, run by Bluepeak Consultant Sdn. Bhd. ("Bluepeak", "we"). By signing in, asking for an account or using the service you agree to them. If you use Bluepeak OS for a company, you confirm you may accept these terms for it.

1. The service

Bluepeak OS is the online workspace Bluepeak uses with the brands it manages: clients, campaigns, tasks, approvals, the content calendar, and weekly marketplace performance. Accounts are by invitation. Asking for an account through the sign-up page doesn't guarantee one; Bluepeak decides whether to open a workspace.

Fees for Bluepeak OS, if any, are part of your service agreement with Bluepeak. Where that agreement says something different from these terms, the agreement applies.

2. Your account

  • Keep your password private and don't share your account. You are responsible for what happens under it.
  • Tell us straight away if you think someone else has used your account.
  • Your brand's admins decide who else joins your workspace and what they can do.

3. Your data

  • You own the data and files you or your team add. You let Bluepeak store and process them only to provide the service and our work for you.
  • Only add data you have the right to share. Don't upload buyers' personal details unless you need to and are allowed to.
  • How we handle personal data is set out in our Privacy Policy.

4. Connected stores

When you connect a Shopee, Lazada or TikTok Shop store you authorise read-only access to the data listed in the Privacy Policy. You can disconnect at any time from the Costs page. Each platform's own terms also apply. Bluepeak is not part of, or endorsed by, Shopee, Lazada, TikTok, Meta or Google.

5. Fair use

You agree not to:

  • use Bluepeak OS for anything unlawful, or to upload harmful code;
  • try to reach another brand's data or get around access controls;
  • copy, resell or reverse-engineer the service, or scrape it with automated tools.

6. Figures, estimates and AI notes

Figures in Bluepeak OS come from marketplace data, your imports and the costs entered, so they are only as complete as that data. Estimates are labelled. Weekly notes drafted with AI can contain mistakes. Nothing in Bluepeak OS is financial, tax or legal advice; check important figures before you rely on them.

7. Availability and changes

We work to keep Bluepeak OS available and secure, but we can't promise it will always be uninterrupted or error-free. We may improve, change or pause features, and we'll give notice of changes that matter to you where we can.

8. Ownership

Bluepeak owns Bluepeak OS, its design and its software. These terms don't give you any rights in them beyond using the service.

9. Liability

As far as the law allows, Bluepeak is not liable for indirect or consequential loss, such as lost profit or lost sales, arising from your use of Bluepeak OS. Our total liability for any claim is limited to the fees you paid Bluepeak for its services in the three months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.

10. Suspension and ending

We may suspend or close an account that breaks these terms or puts the service or other users at risk. When our work with your brand ends, we can give you a copy of your workspace data on request, and then delete it unless the law requires us to keep it.

11. Changes to these terms

We may update these terms. We'll change the date at the top and let you know about important changes. Using Bluepeak OS after that means you accept the new terms.

12. Law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute.
